E-Verify Photo Tool Expanded to Include U.S. Passports

Effective November 11, 2010, the E-Verify photo tool now includes U.S. passports.  Since the photo tool was rolled out in 2007, it required employers to match permanent resident cards and employment authorization documents provided as part of the I-9 process.  U.S. passports are the first step in a plan to further expand the E-Verify photo tool.  According to a press release from the Department of Homeland Security, approximately 10% of E-Verify queries involve a U.S. passport.

Another E-Verify issue of note, the Supreme Court will hear oral arguments on December 8, 2010 in Chamber of Commerce v. Whiting, the challenge to the Legal Arizona Workers Act, including the requirement that all Arizona employers use E-Verify.  A decision could be published next spring.  Attorneys from The Cavanagh Law Firm represent the Chamber of Commerce and a group of business organizations in this case pending before the U.S. Supreme Court.
